BP shares are trading higher Monday following a report suggesting Shell is considering acquiring the company.

The United States Oil Fund fell 1.4% as Brent crude futures slipped 0.7% to trade just under $60 a barrel in early U.S. trading Monday, while West Texas Intermediate futures dropped 1.1% to $57.65.

The report said any final decision about the merger will likely depend on whether BP stock continues to slide.

According to a report by The Times, which cited filings with the U.K.’s Financial Conduct Authority, Elliott’s position against Shell is the biggest short position disclosed against the oil major in nearly a decade.

The oil and gas major said it would raise shareholder distributions to 40% to 50% of cash flow from operations from the earlier 30% to 40% range.
